Terms & Conditions

The specific fees referenced in this agreement are listed on the client’s invoice.

Payment & Cancellation

  • A non-refundable retainer fee is required to reserve your date. This fee secures your appointment on the calendar and will not be refunded for any reason, including client-initiated cancellations.

  • Rescheduling is subject to Sarah Kane Photography LLC’s availability. If notice is given fewer than five (5) weeks in advance during peak months (September–December and April–July), an additional retainer fee will be required.

  • 50% of the remaining balance is due one (1) week prior to the event date. Sarah Kane Photography LLC reserves the right to withhold services if this payment has not been received, and no refund will be issued in that circumstance.

  • The final balance is due within two (2) days after the event date. Editing of final images will not begin until all balances are paid in full.

  • If the final balance is not received within three (3) days after the event date, a late payment fee will be assessed and applied weekly until the account is paid in full.

  • Digital image delivery and any tangible products will not be released until all balances are paid in full.

Services

  • Sarah Kane Photography LLC will begin and conclude services at the agreed-upon times listed on the invoice. If additional coverage time is needed for any reason, the standard hourly rate will apply after a 15-minute grace period beyond the scheduled end time.

  • Due to the organic nature of photography — particularly with young children or in unpredictable environments — specific poses or images cannot be guaranteed. Sarah Kane Photography LLC will always strive to deliver a beautiful, cohesive gallery within the natural flow of your event.

Image Selection, Editing & Delivery

  • Clients will receive their edited digital images via an online gallery, curated by Sarah Kane Photography LLC, within approximately 14 business days following the event. The turnaround count begins on the first business day after the event date. Turnaround times are subject to change based on Sarah Kane’s workload.

Rush Delivery Options

  • 4-business-day turnaround – additional fee applies

  • 7-business-day turnaround – additional fee applies

Rush turnaround counts begin on the first business day following the event.

Standard Editing Inclusions

  • All final images include standard retouching for color correction and exposure adjustment.

  • Formal portraits additionally receive: skin smoothing, minor blemish removal, teeth whitening, and stray hair cleanup.

Additional Retouching

Additional retouching requests beyond the standard inclusions are available at $50 per hour. Examples of edits not included (but not limited to): wrinkled or soiled clothing, dirty shoes or faces, bandages or medical devices, tattoos, makeup corrections, head swaps, and significant object removal.

Complimentary Products, Discounts & Credits

  • Any complimentary products, product credits, product discounts, or service discounts included in a purchased package are subject to expiration dates as specified at the time of purchase. Expired items are non-transferable, have no cash value, and will not be reissued or extended.

Gallery Expiration Policy

  • The client’s proofing gallery and final gallery will each carry an expiration date.

  • If a client fails to download images before the gallery expires, a $50 reactivation fee will extend gallery access for six (6) months.

  • Once a gallery expires, Sarah Kane Photography LLC cannot guarantee retrieval of images. Images may be retained for up one (1) year; however, Sarah Kane Photography LLC is not responsible for any loss of images after the expiration date.

Client Responsibility for Digital Images

  • Upon delivery of digital images, the client assumes full responsibility for storing and safeguarding all files. Sarah Kane Photography LLC is not responsible for lost, deleted, or damaged images and is not obligated to provide replacements.

  • Clients are strongly encouraged to back up all files in multiple locations and refresh those backups at least every six (6) months.

Copyright & Usage Rights

  • All images remain the exclusive copyrighted property of Sarah Kane Photography LLC. Sarah Kane Photography LLC retains the irrevocable and unrestricted right to use and publish images of all parties for editorial, trade, advertising, or promotional purposes in any medium, without restriction. The client is responsible for advising guests of this policy.

Liability Release

  • Sarah Kane Photography LLC shall not be liable for any delay or failure to perform under this Agreement resulting from circumstances beyond its reasonable control, including but not limited to: acts of nature, fire, flood, severe weather, equipment or machinery failure, accidents, family emergencies, or illness.

  • Sarah Kane Photography LLC takes the utmost care in the exposure, transportation, and processing of digital images. In the unlikely event that images are lost, stolen, or destroyed — for reasons within or beyond Sarah Kane Photography LLC’s control — liability is limited to the return of all payments received for the event.

  • By paying the session or retainer fee and booking Sarah Kane Photography LLC, the client agrees to waive and release Sarah Kane Photography LLC and all associated representatives from any and all claims related to injury, illness, or property damage arising out of or in connection with the session or event.
